How to File a Medical Malpractice Lawsuit

Medical malpractice suits are complex. There are specific rules that must be followed including a specified time period within which the suit could be filed.

The plaintiff must also prove that the doctor's actions led to injuries and losses. This will require hospital and medical documents.

Complaint

Your attorney will submit a court complaint as well as summons after he has found evidence of malpractice. The complaint will name the defendants and malpractice lawyer describe the allegations against them.

Malpractice claims are founded on the premise that doctors, nurses or other healthcare providers owe a patient the same level of care. This standard is defined as the level of skill and caution that a reasonably prudent medical professional with the same training could exercise in similar situations. Your legal team has to prove that your doctor breached this standard, resulting in injuries from which you sustained quantifiable damages.

A physician's standard of care is often an issue of opinion and is difficult to prove. It is crucial to choose an attorney who has access to experts in the field of medicine to provide evidence of what a reasonable professional would have done.

Not only doctors can make mistakes, but also hospital staff, such as nurses and anesthesiologists. This is particularly true of emergency room personnel, where mistakes are often made due to a chaotic environment and overworked workers. Your lawyer may be able to secure experts from emergency room staff who can provide evidence of the circumstances that led to the incident and how your doctor failed to fulfill this standard.

Discovery

During the discovery phase your lawyer will gather and examine evidence that may support a malpractice claim. This includes medical records and witness statements as in addition to expert testimony. This information can be requested by the opposing legal team. This is typically done through interrogatories and requests for production of documents. Certain materials could be protected and confidential due to privacy laws, like HIPAA's Privacy Rule.

You must also prove your injury was the result of a doctor's negligence. This is the most difficult aspect of a medical malpractice case because it requires an expert witness testimony that proves your claim.

Your lawyer will also interview witnesses who can prove that the doctor was negligent. This can include assistants, nurses, radiologists, dentists and others who were involved in your treatment. Your lawyer is skilled in taking effective and convincing depositions in order to convince these witnesses to admit that the doctor was negligent.

The majority of lawsuits are settled prior to trial. This is especially common in medical malpractice attorney cases as the costs involved in trial can be expensive. Once the facts of your case have been established, a settlement could be discussed between you and your doctor's insurance company. If no settlement can be agreed upon, your case will proceed to trial.

Trial

After your attorney has completed the initial investigation and concludes that you have a strong malpractice case, they will file the complaint. The complaint will be clear in its allegations and will be given to the defendant along with a summons.

The next step is discovery. This includes the exchange of medical records as well as depositions from witnesses. Your lawyer will use these statements to establish the doctor's breach of standard of care. The aim is to demonstrate that the error was caused by the negligence of the doctor and caused damages.

Apart from the witness's statement Your medical malpractice lawyer will collaborate with two or three expert witnesses to prove your claim. These experts will receive medical records and malpractice lawyer detailed information about your case to prepare for their deposition and testify. They may also assist in preparing your case for trial.

As part of the preparation for trial, your attorney will begin settlement negotiations with the defense. This process can last for several years. During this time, it is important that you are recovering from your injuries and determining how much of your injuries. It's in everyone's interest to settle the matter out of court and avoid litigation whenever possible. Your attorney will carefully compare the merits of any settlement proposal with your current and future recoveries. If the settlement seems reasonable, your lawyer will encourage you to accept it.

Damages

During the discovery phase, plaintiffs will be required to prove that their losses are significant and that negligence on the part of the defendant caused these damages. For instance, if a doctor did not inform the patient that a surgical procedure was associated with a 30 percent chance of losing a limb, and the procedure was completed perfectly but the patient lost their arm, the medical professional may be liable for malpractice.

In order to have a legitimate malpractice lawsuit, the victim must also show that a competent lawyer could have been able stop their financial loss or at a minimum, lessen the amount. This is sometimes referred to as the "but for" test. It is also necessary to show that the plaintiff has incurred expenses in pursuing a successful legal claim, that is greater than the amount they seek in compensation.

Our medical malpractice lawyers are able to provide a detailed explanation of the various types of damages that may be suffered in a malpractice lawsuit including past, present and foreseeable medical expenses loss of income, suffering and pain and suffering, and other non-economic losses. In general, the more severe the injury, higher the award. However, a verdict that is deemed to be a success is sometimes overturned upon appeal. Settlements outside of court can be beneficial to some clients. It can save money and time on litigation costs. It also helps avoid the risk of having a jury choosing a case based on emotion rather than fact.
